39ph Terms & Conditions

In these Terms & Conditions, the following definitions apply unless the context otherwise requires:

• "39ph," "we," "us," "our" refers to the operator of the 39ph platform accessible at https://39ph.asia.
• "Platform" means the 39ph website, mobile web application, and all associated services, games, and features.
• "Account" means the personal account registered by a User on the Platform.
• "User," "you," "your" refers to any natural person who accesses, registers, or uses the Platform.
• "Game" means any online casino game, slot, live dealer table, bingo room, sports wager, or other wagering product available on the Platform.
• "Wallet" or "Balance" means the Philippine Peso (PHP) balance held in your 39ph Account.
• "Bonus" means any promotional credit, free bet, free spin, or matched deposit offer provided by 39ph subject to applicable wagering requirements.
• "KYC" means Know Your Customer — the identity verification process mandated by applicable regulations.
• "PAGCOR" refers to the Philippine Amusement and Gaming Corporation.

To register and maintain an Account on 39ph, you must satisfy all of the following eligibility requirements at all times:

1. You are a natural person and not a corporation, trust, or other legal entity.
2. You are at least twenty-one (21) years of age, consistent with Philippine law governing casino-style gambling.
3. You are physically located within a jurisdiction where accessing online gaming services is not prohibited by applicable law at the time of each session.
4. You are not a current or former employee, contractor, affiliate, or family member residing with an employee of 39ph or any of its related game studios or service providers.
5. You have not previously been self-excluded from 39ph or had an Account terminated for cause.

By completing registration, you warrant that all information you provide — including your full legal name, date of birth, address, email address, and Philippine mobile number — is truthful, accurate, and current. Providing false information at registration is a material breach of these Terms and grounds for immediate Account suspension and forfeiture of balances.

One Account Per Person. Each individual may hold only one (1) Account on 39ph. Creating duplicate accounts, whether under the same identity or different identities, is strictly prohibited. 39ph reserves the right to merge, suspend, or permanently close duplicate accounts and to void all associated wagering activity and balances without prior notice.

Your Account is strictly personal. You must not share your login credentials, transfer Account access, or allow any third party to operate your Account on your behalf. You are solely responsible for all activity conducted through your Account, including any unauthorized activity that occurs as a result of your failure to keep your credentials secure.

39ph is required by applicable Philippine gaming regulations and anti-money laundering laws to verify the identity of its users. By accepting these Terms, you consent to 39ph conducting KYC verification at registration, at the point of first withdrawal, and at any other time deemed necessary by 39ph at its sole discretion.

KYC verification may require you to submit one or more of the following documents:

• A valid government-issued Philippine identification card (e.g., PhilSys National ID, Passport, Driver's License, SSS/GSIS ID, Voter's ID, or PRC ID);
• Proof of current residential address dated within the past 90 days (e.g., utility bill, bank statement, or barangay certification);
• Proof of ownership of the payment method used for deposits (e.g., screenshot of GCash account name matching your registered name).

39ph reserves the right to withhold the processing of any withdrawal until KYC verification is satisfactorily completed. Where KYC documents cannot be verified to 39ph's satisfaction, 39ph may suspend or close the Account and return the deposited principal (net of any bonuses or suspicious transactions) via the original payment method, subject to applicable anti-money laundering procedures.

All deposits to your 39ph Account must be made using payment methods accepted by the Platform, which currently include GCash, PayMaya, BPI, BDO, Metrobank, and approved cryptocurrency channels. 39ph does not accept cash deposits or third-party payment on behalf of another person.

The minimum deposit amount is ₱50.00 (fifty Philippine Pesos), unless a higher minimum is specified for a particular payment method or promotion. 39ph does not charge a deposit fee, though your payment service provider may impose their own transaction fees.

Deposits are credited to your Account Wallet in Philippine Peso. Deposits made via GCash and PayMaya are typically reflected in your Wallet within 60 seconds of a successful transaction confirmation. Bank transfer deposits may take up to one (1) banking business day.

39ph reserves the right to refuse, reverse, or limit any deposit at its sole discretion, including without limitation where there is reasonable suspicion of fraudulent activity, money laundering, or breach of these Terms. Any funds deposited from sources suspected to be proceeds of illegal activity will be reported to the appropriate Philippine authorities.

Currency. All transactions on 39ph are conducted in Philippine Peso (PHP / ₱). Deposits made in other currencies will be converted to PHP at the prevailing exchange rate applicable at the time of transaction; 39ph is not responsible for fluctuations in exchange rates.

You may request a withdrawal of your available Account Balance at any time, subject to the conditions set out in this section. Withdrawals are processed exclusively to verified payment methods held in your own name. 39ph does not process withdrawals to third-party accounts under any circumstances.

The minimum withdrawal amount is ₱100.00 (one hundred Philippine Pesos). Withdrawals via GCash and PayMaya are ordinarily processed within five (5) to thirty (30) minutes of approval. Bank transfers may take one (1) to three (3) banking business days, depending on the receiving institution.

Withdrawal requests are subject to the following conditions:

1. Your Account must be fully KYC-verified before any withdrawal is processed.
2. Any active Bonus funds must satisfy the applicable wagering requirements before the associated balance becomes withdrawable.
3. If a deposit was made via GCash or PayMaya, the corresponding withdrawal will be directed back to the same GCash or PayMaya account by default.
4. 39ph may request additional verification documentation for withdrawal requests above ₱50,000.00 per transaction or ₱200,000.00 per calendar month.
5. 39ph reserves the right to delay or withhold withdrawal processing pending investigation of any suspected Terms violation, fraudulent activity, or technical error.

In the event of a technical malfunction, erroneously credited funds, or any circumstance in which 39ph determines that a balance was credited in error, 39ph reserves the right to reverse the erroneous credit and to recover any funds already withdrawn as a result of the error, including through legal proceedings where necessary.

39ph may, from time to time, offer bonuses, free spins, matched deposits, cashback offers, and other promotional incentives (collectively, "Bonuses") to eligible Account holders. All Bonuses are subject to specific terms published at the time of the promotion, including wagering requirements, qualifying game restrictions, minimum deposit thresholds, time limits, and maximum withdrawal caps.

General conditions applicable to all 39ph Bonuses unless otherwise stated:

• Bonuses are available to one Account per person, per household, per device, and per IP address.
• Bonus funds must be wagered a minimum number of times (the "Wagering Requirement") before they or any winnings derived from them may be withdrawn. The Wagering Requirement for each promotion will be clearly stated in the applicable promotion terms.
• 39ph reserves the right to determine which Games contribute toward wagering requirements and at what percentage (e.g., live dealer games may contribute at a lower percentage than slots).
• Bonuses cannot be transferred between Accounts or exchanged for cash prior to satisfaction of wagering requirements.
• 39ph reserves the right to modify, suspend, or withdraw any Bonus or promotion at any time without prior notice, including where evidence of Bonus abuse is identified.
• Suspected Bonus abuse — including but not limited to coordinated wagering, staking patterns designed to exploit Bonus mechanics, or use of automated betting tools — will result in forfeiture of the Bonus and any associated winnings, and may result in permanent Account suspension.

All Games on the 39ph Platform are supplied by licensed third-party software studios and use certified Random Number Generator (RNG) technology or, in the case of live dealer games, real physical equipment operated by trained dealers in certified studio environments. Return-to-Player (RTP) percentages are determined by the game provider and are available within each game's information panel.

In the event of a discrepancy between the result displayed on your device and the result recorded on 39ph's server, the server record shall be definitive. Game outcomes are final once a round is complete. 39ph accepts no responsibility for disruptions caused by your device, browser, or internet connection.

You acknowledge that online gambling involves an inherent risk of financial loss and that past results do not in any way predict or guarantee future outcomes. 39ph does not represent that any wagering strategy will result in profit.

The following conduct is strictly prohibited on 39ph and constitutes grounds for immediate Account suspension, forfeiture of balances, and where appropriate, referral to relevant authorities:

1. Using the Platform if you are under 21 years of age or if you are legally prohibited from gambling in your jurisdiction.
2. Registering more than one Account, or registering under a false, borrowed, or fictitious identity.
3. Depositing funds that are proceeds of criminal or illegal activity.
4. Using software, bots, scripts, or any automated systems to interact with the Platform in a manner not sanctioned by 39ph.
5. Exploiting software errors, bugs, or technical vulnerabilities — any such instance must be reported to support immediately; any winnings derived from an exploit will be voided.
6. Engaging in collusion with other players or with casino staff.
7. Attempting to reverse-engineer, copy, distribute, or interfere with any part of the Platform or its underlying software.
8. Using a VPN, proxy, or other technology to circumvent geographic restrictions or to disguise your true identity or location.
9. Engaging in any conduct that disrupts, harasses, or harms other users, or that brings 39ph into disrepute.

39ph reserves the right to suspend, restrict, or permanently close your Account, and to withhold or forfeit your Account Balance in whole or in part, in the following circumstances, without limiting other grounds set out in these Terms:

• You have breached any provision of these Terms or any supplemental terms applicable to a specific product or promotion.
• 39ph suspects, on reasonable grounds, that you have engaged in fraudulent, deceptive, or illegal conduct.
• You have provided false or unverifiable KYC documentation.
• Your Account is the subject of a legal claim, regulatory investigation, or court order.
• You have not logged in to your Account for a continuous period of twelve (12) months (inactive account).

You may request closure of your Account at any time by contacting 39ph support via live chat. Upon voluntary closure, any verified remaining balance will be returned to your registered payment method after KYC confirmation and satisfaction of any applicable wagering requirements.

All content on the 39ph Platform — including but not limited to the brand name, logo, website design, software, game graphics, promotional materials, text, and data — is the property of 39ph or its licensors and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for your personal entertainment purposes. No licence is granted to copy, reproduce, modify, distribute, publicly display, or commercially exploit any portion of the Platform or its content without the prior written consent of 39ph.

To the fullest extent permitted by applicable Philippine law, 39ph, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform, including without limitation loss of winnings, loss of data, or service interruptions, even if 39ph has been advised of the possibility of such damages.

39ph's total aggregate liability to you for any claim arising out of or in connection with these Terms or the Platform shall not exceed the total amount deposited by you to 39ph in the thirty (30) days immediately preceding the event giving rise to the claim.

Nothing in these Terms limits 39ph's liability for death or personal injury caused by proven negligence, or for any other matter that cannot be excluded or limited by applicable Philippine law.

39ph provides the following responsible gaming tools to all Account holders, accessible directly within Account Settings:

• Deposit Limits: Set daily, weekly, or monthly maximum deposit amounts. Limit reductions take effect immediately; limit increases require a 24-hour cooling-off period.
• Session Time Reminders: Configure alerts to notify you when a gaming session has exceeded a specified duration.
• Loss Limits: Set a maximum amount you are willing to lose within a defined period.
• Self-Exclusion: Voluntarily exclude yourself from the Platform for periods of 30 days, 90 days, 6 months, 12 months, or permanently. Self-exclusion cannot be reversed before the selected period expires.
• Reality Checks: Periodic on-screen prompts that display your session duration and net wagering result.

39ph is legally prohibited from allowing access to any person who has self-excluded or been identified as a problem gambler. If you are aware that a self-excluded individual is attempting to use 39ph, please contact support immediately.

39ph collects and processes your personal data in accordance with its Privacy Policy, which is incorporated into these Terms by reference. By registering an Account, you consent to the collection, use, and processing of your personal data as described in the Privacy Policy.

39ph complies with applicable Philippine data privacy laws, including the Data Privacy Act of 2012 (Republic Act No. 10173). Your personal data is processed only for the purposes described in the Privacy Policy and will not be sold to unaffiliated third parties. Certain data may be shared with game providers, payment processors, and regulatory bodies as required for the operation of the Platform and compliance with applicable law.

39ph reserves the right to amend, update, or replace these Terms & Conditions at any time. Notice of material changes will be communicated via email to your registered address or through a prominent notice on the Platform. Amendments take effect on the date published. Your continued use of the Platform after the effective date of any amendment constitutes your acceptance of the revised Terms.

If you do not agree to any amendment, you must cease using the Platform and request Account closure before the amendment's effective date.

Governing Law. These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute, controversy, or claim arising out of or relating to these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the competent courts of the Philippines.

Severability. If any provision of these Terms is found to be invalid, unlawful, or unenforceable under Philippine law, that provision shall be severed from the remainder of the Terms, which shall continue in full force and effect.

Entire Agreement. These Terms, together with the Privacy Policy, Responsible Gaming Policy, and any applicable Bonus terms, constitute the entire agreement between you and 39ph with respect to your use of the Platform and supersede all prior agreements, representations, and understandings.
